Dallas Eviction Ordinance Update

On November 9, the Dallas City Council unanimously passed a temporary eviction ordinance that applies to all properties in the city of Dallas. Click here for the ordinance and required notice to be served. 

The temporary eviction ordinance requires a 10-day notice of proposed eviction (instead of 21 days).

  • If the resident does not respond within 10 days, a 3-day notice to vacate may be given. 
  •  If the resident provides proof of application for rental assistance, the resident has 60 days from the date the notice was served to cure any delinquent payments or respond with information about their rent assistance application. 
  •  If their rental assistance application is denied, withdrawn or cannot be processed, a 3-day notice can be given. 

Properties covered under the CARES Act should continue to provide a 30-day notice to vacate for non-payment of rent. This is a federal law that is still in effect and cannot be changed unless Congress takes action.
