What do you do when you receive a notice of bankruptcy for a resident who is delinquent on rent and in the process of being evicted?  Can you continue your eviction? Can you send the resident to collections while they are in bankruptcy?  Does it matter what chapter bankruptcy the resident files? Relying on assumptions or internet searches can land you in a heap of trouble!  That is why is important to stay up to date about the proper procedures and best practices when dealing with resident bankruptcies.  Join Attorney Kimberly Sims as she helps you to navigate dealing with resident bankruptcies.

In this class you will learn:

  • To better understand the bankruptcy process and automatic stay.
  • How a bankruptcy affects your pending eviction and collection efforts.
  • What notices from the bankruptcy court mean.
  • The repercussions of violating the bankruptcy automatic stay and the procedure for lifting the stay.

Kimberly Sims has represented property owners, property management, and landlords for her entire 20-year legal career.  Ms. Sims attempts to resolve disputes before they escalate into litigation and implements practical solutions to avoid litigation when possible. But when it’s not possible, she aggressively pursues her clients’ claims and defends their interests in litigation.  She represents commercial, retail, and muti-family owners and managers in lease disputes, evictions, eviction appeals, right of reentry and repair and remedy cases, commercial lockouts, tenant bankruptcies, and government investigations and actions, including fair housing and discrimination complaints.
